Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Productivity Pilot ("Company," "we," "us," or "our") regarding your use of our workforce management software and services ("Service").

Acceptance of Terms

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Service. These Terms apply to all visitors, users, customers, and others who access or use the Service.

Description of Service

Productivity Pilot provides cloud-based workforce management software that includes:

• Multi-channel attendance tracking
• Automated policy enforcement
• Mass communication tools
• Real-time reporting and analytics
• HRIS system integrations
• Mobile applications and web portal access

User Accounts

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, complete, and current registration information
• Maintain and update your account information
• Maintain the security of your login credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Transmit harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service or servers
• Use the Service for any illegal or unauthorized purpose
• Reverse engineer or attempt to extract source code

Data and Privacy

Your use of the Service is governed by our Privacy Policy. By using the Service, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

You retain ownership of all data you input into the Service. You grant us a limited license to process this data solely to provide the Service as described in your service agreement.

Subscription and Payment

Access to the Service requires a paid subscription. Terms include:

• Subscription fees are based on selected service level and user count
• Fees are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law
• We may change subscription fees with 30 days' notice
• Failure to pay may result in service suspension or termination

Intellectual Property

The Service and its original content, features, and functionality are owned by Productivity Pilot and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes during your subscription term.

Service Availability

We strive to maintain high service availability but cannot guarantee uninterrupted access. We may:

• Perform scheduled maintenance with advance notice
• Suspend service for emergency maintenance
• Modify or discontinue features with reasonable notice
• Implement usage limits or restrictions

Termination

Either party may terminate the service agreement:

• With 30 days' written notice for convenience
• Immediately for material breach of these Terms
• Immediately if the other party becomes insolvent

Upon termination, your access to the Service will cease, and we will delete your data within 90 days unless legally required to retain it.

Disclaimers

The Service is provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

Limitation of Liability

To the maximum extent permitted by law, Productivity Pilot shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, regardless of the theory of liability.

Indemnification

You agree to indemnify and hold harmless Productivity Pilot from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes become effective constitutes acceptance of the new Terms.
